The Buyer has a period of fourteen working days from the date of receipt to return, at his/her own expense and without reason, the Item(s) he/she has ordered. The Item(s) must be returned in its/their original packaging and wrapping to the following address: Demain Sélection, 168 Avenue Louise 1000 Bruxelles. Be sure to send an email to confirm the return to the following address: Hello@demainselection.com
If the above conditions are met, Demain will reimburse the Buyer for the total amount of his order, within thirty days from receipt by Demain of the Items, with the exception of the costs of returning the Items which are the responsibility of the Buyer.
Reimbursement will only be made after verification by Demain of the returned Items. The Items must not have suffered any damage once they arrive at the warehouse. Items whose condition has been clearly altered since their delivery to the Customer will not be taken back.

To deliver its service, DEMAIN SELECTION collects personal data on individuals. Data collection takes place on the DEMAIN SELECTION website.
The purpose of this section is to provide you with complete information on the use made by DEMAIN SELECTION of the personal data of its customers.
DEMAIN SELECTION, as Data Controller, undertakes to comply with the provisions of Regulation (EU) No. 2016/679 of April 27, 2016 relating to the protection of personal data.
In the forms for collecting personal data on the site or in paper format, the Customer is notably informed of the compulsory nature or not of the collection of data. If a mandatory data field is not provided, Demain will not be able to perform its services.

PREAMBLE
The merchant site www.demainselection.com (hereinafter Demain or the "Site") is an online second-hand store for children aged 0 to 14 whose head office is located at 168 Avenue Louise 1000 Bruxelles. For the application of these general terms and conditions of sale, it is agreed that any person coming to consult/visit the Site will be called "Customer", that the Customer and DEMAIN SELECTION will be collectively called the "Parties" and individually called "Party", and that the Customer having validated an order will then be called "Buyer".
ARTICLE 1.
These general terms and conditions of sale govern the rights and obligations of the Parties resulting from the online sale of the Articles offered on the Site, as these Articles are defined in Article 2 below; they apply to the exclusion of any other document. Any order for an Article offered on the Site implies the Buyer's acceptance of these general terms and conditions of sale.
DEMAIN SELECTION reserves the right to modify these general conditions of sale at any time.
The applicable general conditions of sale are those in force on the date the order is placed.
ARTICLE 2. ARTICLES – PRICES
2.1. Articles
Demain offers on its site second-hand clothing, shoes and accessories for children from 0 to 14 years old (hereinafter the “Items”).
The Articles are carefully selected by Tomorrow and meet Tomorrow’s Quality Criteria, namely:
The items you wish to sell must be in excellent condition, washed and ironed. The clothes we sell are:
Without stain
Free of defects that could render the product unusable in part or in full.
In impeccable condition for all buttons, seams, snaps, zippers, laces and other trimmings; but also for the materials which are neither faded, nor worn, nor holed or pilled. Otherwise, this is mentioned.
Only the Articles appearing on the Site on the day of its consultation by the Customer are offered for sale.
The photographs reproduced and illustrating the Articles presented are not contractual. The Customer is invited to consult the description of each Article to know its characteristics.
The Quality Criteria of Tomorrow aim to ensure a selection of Articles according to demanding quality criteria.
However, in the case of second-hand items, Demain cannot be held liable for any defects resulting from previous use of the items. The Customer, by accepting these general terms and conditions of sale, acknowledges that the items are not in new condition.
2.2. Price
When a customer sells his items to Demain, he agrees to accept the prices charged by Demain by validating our repurchase conditions. Our repurchase prices are firm and final.
Prices are indicated in euros, all taxes included.
The value added tax is that in force on French territory.
The prices applied are those appearing on the site at the time of the order.
The prices indicated on the product specifications do not include shipping costs.
The flat rate contribution to shipping costs will be communicated to the customer when placing the order, before validation of the latter.
The price is payable in one payment when ordering the product.
ARTICLE 3. DELIVERIES AND SHIPMENTS
Demain makes every effort to ensure that the order is delivered within an average of 3 to 4 days and a maximum of 8 working days from the day following payment of the order. It is specified that orders recorded on the Site on Friday afternoon, Saturday or Sunday are processed the following Monday. Orders recorded on the Site on a public holiday other than Friday, Saturday and Sunday are also processed the following working day. Delivery of the Item(s) is carried out by BPOST throughout Belgium.
The risks relating to delivery are the responsibility of the Buyer from the moment the Articles leave Demain's premises.
Demain cannot be held responsible for the condition of the package or delivery times.
The Items ordered by the Buyer are delivered to the address indicated by the Buyer, accompanied by a delivery note.
The Buyer has the option of having the Items delivered to an address other than his own. Delivery will not be ensured in the event of force majeure as defined in Article 7.1. below.
ARTICLE 4. RIGHT OF WITHDRAWAL
The Buyer has a period of fourteen working days from the date of receipt to return, at his/her own expense and without reason, the Item(s) he/she has ordered. The Item(s) must be returned in its/their original packaging and wrapping to the following address: Chaussée de charleroi 123 1060 Saint gilles.
If the above conditions are met, Demain will reimburse the Buyer for the total amount of his order, within thirty days from receipt by Demain of the Items, with the exception of the costs of returning the Items which are the responsibility of the Buyer.
Reimbursement will only be made after verification by Demain of the returned Items. The Items must not have suffered any damage once they arrive at the warehouse. Items whose condition has been clearly altered since their delivery to the Customer will not be taken back.
ARTICLE 5. WARRANTY AND LIABILITY
Under no circumstances can Demain be held responsible for any apparent or hidden defects in the Articles or any possible counterfeits of the Articles presented on its Site.
ARTICLE 6. DATA PROTECTION AND FREEDOM
Certain web pages of the Site may contain web beacons which make it possible to count the number of visitors to the Site and/or provide Demain with a certain number of indicators.
In any event, the information obtained via these tags is strictly anonymous and simply allows us to gather statistics on the traffic on certain pages of the Site, in order to better serve the Customers of our Site.
ARTICLE 7. MISCELLANEOUS STIPULATIONS7.1. Force majeure
Tomorrow will not be liable for the total or partial non-performance of its obligations under this contract, if this non-performance is caused by an event constituting force majeure, in particular in the event of disruption or total or partial strike in particular of postal services and means of transport and/or communication, flood or fire.
7.2. Entire contract
These general terms and conditions of sale, the order summary and the invoice sent to the Buyer form a contractual whole summarizing all of the agreements entered into between the Parties.
7.3. Applicable law – Competent jurisdictions
These general terms and conditions of sale and the contractual relations between DEMAIN SELECTION and the Buyer are subject to French law. In the event of a dispute, the Belgian courts will have sole jurisdiction. DEMAIN SELECTION, however, undertakes to seek an amicable solution before any legal action.
